Agreement on the user agreement and the use of the site "Garant.am"

The user agreement between the Garant.am website, on the one hand, and the user and owner of the advertisement, on the other hand, governs the use of the website and its services. This agreement is a legally binding document for all users of the site. When using the site and its services, the user and the owner of the ad agree to the terms of this agreement.

Definitions of terms

1.1. Garant.am is a website designed to provide housing search and rental services, as well as marketplace services. 
1.2. User - an individual or legal entity using the site and its services to search for housing, organize rentals and gain access to the marketplace services. 
1.3. The owner of the ad is a natural or legal person who has placed an ad on the website about the offer of housing for rent.

2.1. To use the site and its services, you must go through the registration procedure. 
2.2. When registering, the user provides reliable information about himself. 
2.3. The owner of the ad when placing an ad on the site is also obliged to provide reliable information about himself and the property. 
2.4. Garant.am is not responsible for the accuracy of the information provided by the user or the owner of the ad.

Use of the site and its services

3.1. The user and the owner of the ad undertake to use the site and its services only for lawful purposes and in accordance with applicable law. 
3.2. The user and the owner of the ad do not have the right to use the site and its services to disseminate information that is contrary to applicable law, as well as to carry out fraudulent activities and other illegal actions. 
3.3. Garant.am has the right to restrict or terminate access to the site and its services in case of violation by the user or owner of the announcement of the terms of this agreement.

Placing an ad on the site

4.1. The owner of the ad undertakes to place on the site only reliable information about the housing offered for rent. 
4.2. The owner of the ad is fully responsible for the content of the ad placed, as well as for the provided photos and description of the property. 
4.3. Garant.am is not responsible for the content of the advertisement posted on the site, as well as for the quality of the housing offered for rent.

Payment for services

5.1. When using the services of the site, the user and the owner of the advertisement are required to pay the appropriate fee. 
5.2. Garant.am has the right to change the cost of services and tariffs at any time, notifying users and ad owners about this in advance. 
5.3. Payment for services is made according to the tariffs in force at the time of payment. 
5.4. Garant.am is not responsible for possible commissions charged by payment systems when paying for site services.

Confidentiality

6.1. Garant.am undertakes to maintain confidentiality of information provided by the user and the owner of the ad when registering on the site and using its services. 
6.2. Garant.am has the right to use the information provided by users and owners of ads only to improve the quality of the site's services and to inform users about new services and functions of the site.

Responsibility

7.1. Garant.am is not responsible for losses incurred by users or ad owners as a result of using the site and its services. 
7.2. The owner of the listing is solely responsible for compliance with the law when renting housing, as well as for the information provided about the housing. 
7.3. The user and owner of the ad are responsible for any violations committed by them when using the site and its services.

Tax Liability

8.1. Garant.am bears no tax liability for ad owners and is not a tax agent in relation to ad owners. 
8.2. The listing owner is fully responsible for paying all taxes and fees associated with the rental of housing, in accordance with applicable law.

Agreement provisions

10.1. This agreement is the only agreement between users, ad owners and Garant.am regarding the use of the site and its services. 
10.2. This agreement is governed by the current legislation of the Republic of Armenia. 
10.3. If any provision of this agreement is found to be invalid or unenforceable, this will not affect the validity or enforceability of the remaining provisions of the agreement. 
10.4. Garant.am has the right to change this agreement at any time by notifying the users and owners of ads in advance. 
10.5. This agreement comes into force from the moment of registration of users and owners of ads on the site and is valid until they are removed from the site.

Confidentiality

11.1. Garant.am undertakes to maintain the confidentiality of all personal data of users and ad owners, in accordance with the legislation of the Republic of Armenia. 
11.2. Users and owners of ads undertake to provide accurate and reliable data when registering on the site, and also not to disclose their personal data to third parties.

Intellectual property

12.1. All rights to trademarks, logos, design, graphics, software, databases and other materials posted on the Garant.am website belong to Garant.am or its partners. 
12.2. No material posted on the site may be copied, reproduced, modified, distributed or used without the prior written permission of Garant.am or its partners.

Responsibility

13.1. Garant.am is not responsible for any damage, direct or indirect, resulting from the use of the site or its services. 
13.2. Garant.am is not responsible for the quality, safety or legality of the accommodation posted on the site, as well as for the actions or omissions of the ad owners or users. 
13.3. Users and owners of ads are fully responsible for violation of applicable law when using the site and its services.

15.1. This agreement is signed by users and owners of ads in electronic form when registering on the site. 
15.2. This agreement does not require the signature of Garant.am and is considered concluded from the moment of registration of users and owners of ads on the site.

Amendment and addition to the contract

16.1. Garant.am has the right to change the terms of this agreement at any time by posting a new version of the agreement on its website. 
16.2. Changes and additions to this agreement come into force from the moment they are posted on the website. 
16.3. Users and owners of ads undertake to regularly check the Garant.am website for changes in the terms of the contract.

Dispute Resolution

17.1. All disputes and disagreements arising between the parties in the performance of this agreement shall be resolved through negotiations between the parties. 
17.2. If the parties fail to reach an agreement as a result of negotiations, disputes are referred to the judicial authorities in accordance with the procedure established by the legislation of the Republic of Armenia. 
18.1. This agreement is the entire agreement between the parties and supersedes all prior agreements and understandings between the parties. 
18.2. If any provision of this agreement is declared invalid, this does not affect the validity of other provisions of the agreement. 
18.3. This agreement is governed by and interpreted in accordance with the legislation of the Republic of Armenia. 
18.4. This agreement comes into force from the moment of registration of users and owners of ads on the Garant.am website and is valid until it is terminated by one of the parties in accordance with the terms of the agreement.
